Welcome to Music Stream, a service offered by (« MUSIY», « StreamMusic », « we », « us » « our ») and our Terms and Conditions of Use. This affects your StreamMusic mobile application and website usage (« the service », or « mobile application »).

These Conditions of Use, and our Privacy Policy constitute a legal agreement, which is a contract (the « Agreement ») between you and StreamMusic , concerning StreamMusic usage.

Children who are less than 13 years old are not authorized to use the service or try to sign up.

Terms

In compliance with Section 12 of the law 78 – 17 of the 6th January 1978 related to computer software, files and freedom, you have the right to consult, modify, rectify, and delete all data you relayed to us. For that, you have to send us an email at musicstreameronline(at)gmail(dot)com.

Acceptance of the Terms of Use

By reaching and using StreamMusic or by reaching to the content of the application, you declare that you guarantee that you read and understood the Conditions of Use as well as the confidentiality policy and the community rules, that you stand by it, that you are legally an adult or that you have more than 13 years and your parents or guardian give you the right to use the StreamMusic mobile application.

Description of the StreamMusic service

The Service is a music player that gives you access to YouTube music videos (« YouTube content » ). The Service is provided solely for your own non-commercial use. The service enables users to like and share YouTube content within the app. The Service is free to download, only some features are to be paid for.

The Service is a third-party software compliant with the YouTube’s Terms of Service and all videos are play via YouTube’s official API Embedded Player.

In order to use the Service, you must receive data connectivity services from your service provider. The cost of the data connectivity service may vary among service providers. It is your responsibility to review such costs and to determine whether you wish to bear such costs or not. In particular, you further acknowledge that the cost of such data connectivity service may rise significantly when roaming internationally. Therefore, you are advised to consider the cost of using the Service, depending on your location at any particular time.

IMPORTANT:

  • When the User’s terminal is not connected to a Wifi network but to a mobile broadband internet access and data credit provided by its operator, the User acknowledges and accepts that the use of the Services is charged as credit data or invoiced in addition where they are considered to be out of plan.
  • Payment of potential and/or additional third party costs, and in particular of roaming charges, in the event of use of the Services outside of the country where the User is established, invoiced by the User’s network operator are payable in full by the User. The payment of third party costs is the sole responsibility of the User.

Intellectual property

The brands of the Company and its partners, and logos appearing on the website and / or Software are registered brands. Total or partial reproduction of these trademarks or logos without the consent of the Company or its partners is prohibited.

Privacy policy – StreamMusic

The platform can give you access to websites, databases, networks, servers, information, software, programs, systems, directories, applications, products or services, third party (hereinafter "external services", "third party services"). All videos are provided by the public third-party media service YouTube. All trademarks and copyrights belong to their respective owners and are used here under the terms of Fair Use and the Digital Millennium Copyrights Act (DMCA). StreamMusic simply links to content on YouTube via YouTube’s 3rd party Developer API Stream does not have any direct control of YouTube's content. If there are any videos that may infringe upon anyone's copyrights, the following link can be used to report the videos to YouTube: http://www.youtube.com/t/dmca_policy StreamMusic allows users to authenticate with their Google account in order to use some features. Please check the Google Privacy Policy to understand how your data is managed by Google.

StreamMusic has no control over external services, and is not, and can not be responsible for their content, operation or use. By pointing or otherwise providing access to external services, StreamMusic makes no warranty or does not expressly or implicitly endorse, in relation to the legality, the accuracy, the quality or the authenticity of the content, information or services provided by these external services.

External services may have their own terms of use and / or confidentiality policy, and may have different practices and those requirements are explained by StreamMusic towards its platform. You are responsible for reviewing the Conditions of Use of these external services.

You are responsible for taking the precautions to protect yourself against fraud while you are using external services, and you have to protect your systems against viruses, worms, Trojan horses, and other harmful content or destructive and documents that can be included or may emanate from these external services.

StreamMusic disclaims any liability for any damages arising from your use of external services, and you irrevocably waive any claim against Stream, regarding the content or functioning of all external services.

COLLECTION AND USE OF PERSONAL DATA

When you download or update the application, we may collect and process some of your data, such as (i) the advertising ID of your device(s), (ii) technical data of your device(s) (which may include but is not limited to information such as the model name or number, brand, operating system, screen size, screen resolution, default language, time zone of your device(s), third party applications installed on your device(s)) and (iii) mobile operator-related data (which may include but is not limited to information such as the name of the operator and the SIM card country code).

Once the application is downloaded and installed, we may also collect some data related to listening or viewing of music and / or audiovisual content on your devices (songs, genres, artists, playlists, etc.). This data may either be generated through the use of our application and services or transmitted by the operating system of your devices in accordance with the rules set by the operating systems. This data may be used in order for us to (i) provide you with our services in the best possible conditions, (ii) improve our products and services as well as your user experience (iii) carry out analytical and statistical studies regarding the use and viewing of musical and / or audiovisual data in particular, (iv) customize the advertising offer featured on our application or on our partners' websites and applications, and (v) provide you with tailor-made offers and information about products and services that we believe you may be interested in, consistent with any permissions you may have communicated to us.

This data is processed by StreamMusic and can also be shared or transferred to StreamMusic partners or service providers (advertisers in particular) in charge of the analysis or processing of this data on behalf of StreamMusic and for the purposes described above.

StreamMusic may also collect information about the app usage, such as the most played videos.

This information is used to improve the quality of the service and to provide general statistics regarding the usage of Stream.

StreamMusic may also collect information about the pages that are visited by users within the service. Data on pages that are visited are never linked to your personal information. The Personal information is collected in order to access value-added services.

If you decide to give your consent, your data can be used for the promotion of StreamMusic activities. StreamMusic may disclose personal information only if required by law or if we have the firm conviction that such action is necessary to:

  • comply with local laws and regulations
  • protect and defend the rights or property of Stream

CONNECTION

When you register or log in to one of our services, we may collect and process some of your PII data which may include but is not limited to information such as your email address, name, gender, date of birth. This data may be used in order to (i) improve user experience which may include but is not limited to our music recommandation services, saving the users musical preferences and playlists, (ii) improve our products and services as well as your user experience (iii) carry out analytical and statistical studies which are performed on anonymized data (iv) provide you with tailor-made offers and information about products and services that we believe you may be interested in, consistent with any permissions you may have communicated to us. This data is processed by MWM for the purposes described above. This data will not be shared or transferred to MWM partners or any 3rd part services.

ADVERTISING

Advertising partners - ad networks - help us to serve advertisements to you. Some of this technology also helps us to make decisions as to whether or not to show a particular advert to you – for example, by informing us that you have shown an interest in similar goods or services previously.

Our advertising partners may collect information about you when you use our services or the services of others. This Privacy Policy does not apply to the collection of your information by our advertising partners, and we therefore recommend that you review their privacy policies for more information. You can find out more in “How to adjust your preferences” below.

How do ad identifiers and similar technologies work?

Advertisers on mobile devices sometimes use advertising (or ad) identifiers to enable and optimise their advertising. Ad identifiers are non-permanent, non-personal device identifiers such as the Android advertising ID and/or Apple’s ID for advertising, or IDFA. See below for you can reset these identifiers or indicate your preference that they should not be used for advertising purposes.

Third parties who advertise on our Services may use cookies or similar technologies such as tracking pixels in their advertising. These technologies operate either by: (i) placing a small file which stores some information on your computer or mobile device; and/or (ii) by accessing information on your device. These technologies allow the collection of data, such as your device’s model, operating system and screen size, the other applications installed on your device, and information about how you use our services.

How to adjust your preferences

You can choose to prevent your device’s ad identifier being used for interest based advertising, or you can reset your device’s ad identifier, by changing the settings of your device. Settings vary from device to device but you will usually find the ad identifier settings under “privacy” or “ads” in your device’s settings.

Please note that adjusting your preferences as described in this section does not mean you will no longer receive adverts, it only means the adverts you do see will be less relevant to your interests.

Alternatively, if you do not wish us to collect data as described in this section, you should stop using our services.

CONTROL AND ACCESS TO PERSONAL INFORMATION

Personal information will always be used for the purposes described above. The registration, if necessary, also enables the user to specify whether you want to be contacted by StreamMusic and how such contacts should occur. StreamMusic gives users all the tools they need to ensure that personal information is accurate and current.

You can also adjust the settings of your devices concerning your data processing. On these settings, you will be able to reset your device’s advertising ID and/or limit targeted advertising on your device.

StreamMusic reserves the right to change the contents. If we use your personal information otherwise specified in the legal information provided at the time of data collection, users will be informed through advertisements published by StreamMusic .
